Sales Tax
We must charge 5% sales tax on all orders within the state of Maine. No sales tax will be charged to orders from other locations.

Ordering by Phone
After completing the order form, either print the form or have it on your computer screen when you are ready to call. To place your order, simply dial 1-888-552-4449 from any location within the United States or Canada. We are open and answering calls Monday - Friday 9AM-5PM Eastern Standard Time.

Ordering by Mail
If you prefer to pay by Money Order or Personal Check, you can mail your order to us. After printing the online order form, mail your order to us at the address above.

Shipping
We will ship most (non-furniture) orders within one business day of your placing the order with Sparkability. All domestic orders can be sent by UPS. Shipping to Alaska and Hawaii require an additional delivery time and charge. If this causes you any inconvenience please contact us and we will work with you to arrange special shipping.

International Shipping
We are happy to ship most of our products to any location in the world. Please select International Shipping as the shipping method when placing your order online. The shopping cart will generate an estimated shipping cost, and we will contact you with any adjustments to the shipping charge before your order is processed.

Overnight Delivery Time
Credit Card within 2 days of order placed; orders placed by 11:00 am EST (Monday - Friday) will be received the next day. Money Order within 7 days of order placed. Personal Check within 14 days of order placed.

Ground Delivery Time
Credit Card within 14 days of order placed. Money Order within 14 days of order placed. Personal Check within 21 days of order placed.

Payment
We are able to accept the following forms of payment (Unfortunately we cannot accept C.O.D. orders):

* Pay by Credit Card - We accept MasterCard, Visa, and American Express for order payment. Orders are not charged until they are ready to ship. Our charge will appear on your credit card statement as "Shiny Things, LLC"

* Pay by Check or Money Order - If you choose to mail your order to us you may pay by personal check or money order (In addition to Credit Card). Please do not send cash! All payments must be in US Dollars and need to be payable to "Shiny Things, LLC."

You will be charged $20.00 for any check that is "bounced" or rejected. We cannot be responsible for late, lost or misdirected mail. We suggest you request a proof of delivery. Once we receive your mailed payment and it has been authorized (This process can take up to 21 days for personal checks) we will ship your order.

Receiving Furniture/Swingset Shipments
Most furniture items will be shipped via a standard freight carrier. Most carriers schedule deliveries Monday-Friday, 9:00am-5:00pm. Customers must be onsite to receive, inspect, and sign for delivery. Arrangements should not be made to have shipments dropped off when no one is onsite to receive them. For residential deliveries – when contacted by the carrier, it is important to make note of the carrier’s name and phone number. This will be very helpful if the carrier needs to be contacted for any reason. It is essential that the carrier be contacted should there be a need to reschedule a delivery. When delivery appointments are missed, the carrier will apply a missed appointment charge of $60. Our vendors take great care in packaging items to ensure safe transport. Even though items are packaged properly, transit-related damage can occur. When an order arrives, it is imperative that it be inspected carefully and that any damage to the order and/or to the packaging materials is noted on the delivery receipt. Shipping documents should not be signed without recording details of transit damage. (For example: the furniture is scratched, dented, cracked; the fabric is torn; the box is crushed on the top corner, punctured, or wet.) Upon inspection, if the item(s) is damaged, the customer may choose to refuse the delivery. Please note that Nurseryworks ships flat packed. If only one box of an order is damaged, the customer should refuse only the specific box that is damaged.

Cancellations
We make every effort to ship your order as quickly as possible - usually within 24 hours. If you contact us before your order is shipped we are more than happy to Change or Cancel your order. Furniture orders must be cancelled within 48 hours of the order being placed.

Non-Furniture or Swingset Returns / Exchanges
We want you to love the item you’ve received. If you would like to exchange or return your gift, we are happy to replace it with another selection, issue a gift certificate or refund the credit card used for purchase. You can return any unused item in its original condition for a full refund of the purchase price (including sales tax) within 30 days of the purchase.

Please note: Furniture items, swingsets and sale items may not be returned.

To return an item, wrap the item in its original packaging, if possible, with the packing slip and follow these simple steps:

1. Contact our Customer Service department toll-free at 888.552.4449. Our staff is available from 9am - 5pm EST, Monday through Friday. You must contact Customer Service before returning any product, for any reason.

2. Write down the Return Merchandise Authorization (RMA) number given to your by the customer service representative.

3. Include the RMA number on both the outside and inside of your return package.

4. For your security, we recommend that you return your item with an insured carrier (e.g., FedEx, UPS, USPS Parcel Post) and retain a receipt for your records. This will protect you in the even the item is damaged or lost in transit.

5. If you are returning an item because it was delivered to you damaged, defective, or was the incorrect item, we will provide you with a pre-paid return label.

Furniture/Swingset Returns/Exchanges
Due to the custom nature of these items, we do not accept returns or exchanges. If an item has been received and it is not the actual item ordered, all of the original packaging must be retained. Please e-mail or call and be sure to have the order number on hand. We will arrange to have the incorrect item picked up immediately and the correct one sent.

Furniture/Swingset Claims
We will not be able to place a claim or work with a customer to replace damaged items, if damage is not noted at time of delivery. Customers should retain all packaging until the order has been fully inspected.

We will be unable to assist with repair or replacement of damaged merchandise if it is not thoroughly inspected and documented as described above.

It is the customer’s sole responsibility to notify us of any claims for damage within 14 days; otherwise, we will be unable to assist with a claim. The customer waives any rights to set off or hold back amounts of paid or due hereunder against any other amounts owed for merchandise purchased from Nurseryworks.

Furniture/Swingset Manufacturing Defects
If a shipment arrives with the appearance of a manufacturing defect, we must be notified by e-mail or phone within 14 days of receipt. We require digital pictures and a full description of the problem. Without a digital picture, no item or part will be replaced. Once there is a determination that there is a manufacturing issue, the required part(s) will be shipped as soon as possible. The original item and packing must be kept. Returns should be complete with original packaging. Items returned incomplete or damaged may be assessed a restocking fee.

Furniture/Swingset Finish Variations
All furniture products are crafted by hand, so there may be variations in both the texture and color of the finishes. These variations are not considered manufacturing defects.

Force Majeure
We shall not be held liable for nonperformance or delay caused by an occurrence beyond our reasonable control, including, but not limited to, embargo, war, national emergency, sabotage, accident, and government laws.

Correction of Errors and Inaccuracies
The information on this website may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We apologize for any inconvenience this may cause you. Pricing Policies
All prices are in U.S. Dollars. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
